Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and GrowLog AI (“GrowLog AI,” “we,” “us,” or “our”) governing your access to and use of our websites, applications, and related services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 13 years old (or 16 in the EEA/UK) to use the Service. You are responsible for the accuracy of information you provide, for safeguarding your credentials, and for all activity under your account. Notify us immediately of any unauthorized access at hello@growlogai.com.

The Service provides an AI-assisted garden advisor and diary that stores your observations, generates recommendations, and helps you track crops over time. Features may be added, changed, or removed at our discretion. Some features depend on third-party services (such as Google Sheets and LLM providers) and are subject to their availability.

The Service uses large language models (“LLMs”) to generate responses based on your inputs. AI output may be inaccurate, incomplete, biased, outdated, or otherwise unsuitable for your specific situation. The Service is provided for informational and educational purposes only and is not a substitute for professional horticultural, agricultural, medical, veterinary, environmental, legal, or other professional advice.

You are solely responsible for evaluating AI output before acting on it, including any decisions about pesticides, herbicides, fertilizers, edible plants, foraging, allergies, or animal care. Never consume a plant identified by the Service without independent verification.

“User Content” means anything you submit to the Service, including messages, photos, notes, and data. You retain ownership of your User Content. You grant GrowLog AI a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, display, and create derivative works of your User Content solely as needed to operate, secure, and improve the Service for you, including by sending it to LLM providers to generate responses.

You represent that you have all rights necessary to submit your User Content and that it does not violate any law or third-party right. You may delete your User Content at any time, subject to backup, log, and legal-retention exceptions described in our Privacy Policy.

You agree not to:

• Use the Service for any unlawful, harmful, or fraudulent purpose.
• Submit content that infringes intellectual property, privacy, or other rights, or that is defamatory, harassing, or hateful.
• Attempt to reverse engineer, scrape, overload, disrupt, or circumvent security measures of the Service.
• Use the Service to develop a competing product, train machine learning models, or systematically extract content.
• Submit personal data of others without their consent, or sensitive categories of data we have not authorized.

The Service integrates with third-party providers, including LLM providers, weather data sources, authentication providers, and optional storage destinations such as Google Sheets. Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services.

The Service is currently offered free of charge during early access. We may introduce paid plans in the future and will provide notice before any charges apply. Beta features may be incomplete, may change without notice, and may be discontinued.

The Service, including software, design, text, graphics, and trademarks (other than User Content), is owned by GrowLog AI or its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial gardening use.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, create risk or possible legal exposure for us, or if we discontinue the Service. Sections that by their nature should survive termination (e.g., ownership, disclaimers, limitations of liability, indemnity, and dispute resolution) will survive.

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI OUTPUT WILL BE ACCURATE OR RELIABLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GROWLOG AI AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, CROPS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) US $50.

You agree to defend, indemnify, and hold harmless GrowLog AI and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your User Content, your use of the Service, or your violation of these Terms or applicable law.

These Terms are governed by the laws of the State of Connecticut, United States, without regard to its conflict-of-laws rules. The parties consent to exclusive jurisdiction in the state and federal courts located in Hartford County, Connecticut, except where prohibited by applicable consumer-protection law.

We may modify these Terms from time to time. If changes are material, we will notify you (for example, by email or in-app notice). Continued use after the effective date constitutes acceptance of the revised Terms.
